Electronic Signature and Records Consent
How Easy Impound uses electronic signatures and electronic records, your right to paper copies, and how to withdraw your consent.
This Electronic Signature and Records Consent (“Consent”) explains how Easy Impound, operated by ON-Time Prop Pay LLC (“Easy Impound,” “Company,” “we,” “our,” or “us”), uses electronic signatures and electronic records when you create an Account, sign up for the Platform, or sign documents through the Easy Impound online customer portal (the “Platform”). Before you can sign any document electronically on the Platform, federal and state law require that we obtain your consent to do business with you electronically. This Consent supplements Section 21 (Electronic Consent and Signatures) of the Easy Impound Terms of Service (the “Terms”). Please read this Consent carefully.
1. Your consent to electronic signatures and records
By checking the “I agree” box, typing your name, selecting “I Agree” / “Sign,” or otherwise submitting an electronic signature on the Platform, you (the “Customer”) agree that:
- Your electronic signature on any document on the Platform is legally the same as a signature made with pen and ink, and is intended to bind you to the terms of that document, including the Terms and any Sponsor Bank Account Agreement.
- You consent to receive, review, and sign disclosures, agreements, invoices, notices, receipts, and other records related to your Account and the Platform (“Records”) in electronic form, instead of on paper.
- This Consent applies to every document you sign or every disclosure Easy Impound provides through the Platform for your current transaction and, unless you withdraw your consent as described below, for future transactions with Easy Impound.
This Consent is provided in accordance with the Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”) and applicable state law.
2. Your right to receive paper copies
You are not required to sign documents electronically. You may request a paper copy of any Record at no additional charge by contacting Easy Impound using the information at the top of this Consent. If you choose not to consent, or later withdraw your consent, Easy Impound will provide paper copies, and completing your transaction by mail may delay processing of your Account.
3. Withdrawing your consent
You may withdraw this Consent at any time by closing your Account or by notifying Easy Impound in writing (by email or mail) using the contact information above. Withdrawal will apply to future Records only — it will not affect the legal validity of any document you already signed electronically or any Records already provided to you electronically. Withdrawing your consent may delay or limit Easy Impound’s ability to process your Account or provide Platform services.
4. Updating your contact information
It is your responsibility to keep the email address and other contact information in your Account current so that you can receive electronic notices and Records. You can update your information by logging into your Account or by contacting Easy Impound directly.
5. Hardware and software requirements
To access, view, sign, and retain electronic Records through the Platform, you will need:
- A computer, tablet, or smartphone with a current web browser and an active internet connection;
- A valid, active email address capable of receiving messages and attachments;
- Software capable of viewing PDF files (such as free PDF reader software); and
- The ability to download, save, and/or print Records for your own records if you wish to keep a copy.
If Easy Impound’s system requirements change in a way that creates a material risk that you will not be able to access or retain Records, Easy Impound will notify you and confirm you still wish to consent to electronic delivery.
6. Governing law
This Consent is governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles, consistent with Section 20 (Governing Law) of the Terms. Nothing in this Consent deprives you of any non-waivable rights afforded under the laws of your state of residence.
7. Acknowledgment
By signing electronically in the Platform’s sign-up flow, you acknowledge that you have read and understood this Electronic Signature and Records Consent, that you are able to access and retain electronic Records as described above, and that you consent to sign documents and receive Records electronically from Easy Impound. For its records, the Platform automatically captures the date, time, and IP address associated with each electronic signature.
